Terms of Service

These Terms apply when you use thebogeycompany.com, create an account, place an order, or book an event with Bogey & Company ("we," "us"). If you do not agree, please do not use the site or order from us.

You must be at least 18 years old, or the age of majority where you live, to create an account, place an order, or enter into an event agreement.

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for activity under your account. Tell us promptly if you believe your account has been used without your permission. We may suspend or close accounts used in violation of these Terms.

You keep ownership of the artwork, logos, images, and text you submit. You confirm you own that content or have permission to use and reproduce it for the products you order.

You grant us a limited, non-exclusive license to store, adapt, resize, reposition, and reproduce your content solely to prepare proofs, produce your order, run your event, keep your saved designs available, and provide customer support. We will not use your artwork in our own marketing without your permission.

Production begins only after you approve a proof. Approval confirms artwork, spelling, layout, quantity, and product selection. Digital previews are approximate. Full details are in Artwork & Proofs, which is part of these Terms.

Prices, product availability, and product details may change, and we may correct pricing or description errors before an order is produced. Online orders are placed and paid through Shopify checkout; event orders follow the payment schedule in your proposal. Applicable sales and use taxes are added where required. Orders are accepted at our discretion, and we may decline or cancel an order and refund amounts paid.

Proof review, production, and carrier transit are separate stages, and timing estimates are not guarantees. Date-critical and rush orders require our written confirmation. See Shipping & Turnaround, which is part of these Terms. Risk of loss passes when the carrier takes possession.

Custom products are generally final sale after proof approval. Damage, defects, material mismatch, and our errors are handled under Returns & Reprints, which is part of these Terms and includes a 7-day reporting window.

An inquiry does not reserve a date. A date is confirmed when you accept the written proposal and any specified deposit is received. Scope, guest count, travel, deadlines, cancellation, and rescheduling terms are set out in that proposal and supported by Event Requirements. Where a signed proposal conflicts with these Terms for that event, the proposal controls.

The Bogey & Company name, logo, site design, photography, copy, and software are owned by us or our licensors. You may not copy, scrape, or reuse them without permission, other than normal personal use of the site.

You agree not to:

• Submit artwork you do not have the right to reproduce.
• Submit content that is unlawful, hateful, harassing, obscene, defamatory, or that infringes another party's rights.
• Interfere with, probe, or attempt to gain unauthorized access to the site or our systems.
• Use automated tools to scrape or overload the site.
• Resell or misrepresent our services.

We may refuse or cancel any order or artwork that violates this section.

Parts of the experience rely on third parties, including Shopify for checkout and payment, our backend platform for accounts and storage, AI providers for optional artwork generation, email delivery services, and shipping carriers. Their own terms and privacy practices apply to the portions they operate, and we are not responsible for their services.

The site and services are provided "as is" and "as available." To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, exact color matching, or that a digital preview will match the printed product precisely. Nothing here limits rights you have under applicable consumer protection law.

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or lost opportunity, arising from your use of the site or our products or services. Our total liability for any claim relating to an order or event will not exceed the amount you paid us for that order or event.

You agree to indemnify and hold us harmless from third-party claims and reasonable costs arising from artwork or content you submit, your breach of these Terms, or your misuse of the site or services.

You may stop using the site or close your account at any time. We may suspend or terminate access for violations of these Terms or to protect our systems or other customers. Sections that by their nature should survive — including intellectual property, disclaimers, liability limits, and indemnity — survive termination.

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Disputes will be handled in the state or federal courts located in Michigan, and you and we consent to that jurisdiction.
